I had decided to upload my TDK TV to Vimeo, to avoid the copyright troubles I encounter with Youtube. Alas, I've received a notification that Warner Bros had requested Vimeo to take down my Everwood video. :-(

So, I have a question to all the video site users:
- If I set a video as "private" on Vimeo, will it be protected from WB requests ?
- Are they other sites where I could upload my videos ?

I know I'm playing in the grey areas here, and I can't complain, but still, I do. ;-)

Sorry to hear that, I just had a copyright scare the other day myself and that sucks.
I don't know about other sites (well, I know a few, but I haven't tried them out) but I think you should be safe if you set your video to "private" on vimeo. Just set it to private instantly after uploading.

I don't know if you're the same as me, but personally I'm a bit scared now to even try and upload something again (the problem I had wasn't with vimeo, though, it was with mediafire and it was because I hadn't set the file to private yet). What I'll probably do is wait at least a few days before I try to upload something again.

Concerning other sites: With all those copyright restrictions and all, I don't think there is a site that's "safe" for you to upload copyrighted material, anyway. You'll probably get problems no matter where you're uploading it to.

Not much help here, but I would guess that private or no, they'll catch it anyway. It's just a program going over the media files.

What did vimeo do?

I had/have problems with mediafire too, but all they do is mark it as copyright and in essence set it to private. You can still download nobody else can.

Vimeo took down the video. It doesn't exist anymore.
I'm not sure if it's a program. Youtube uses a program, and catch most of the video during the upload. When the program recognises copyrighted material, your video is blocked and you get a message saying it recognized the material as being owned by one or another big company. But sometimes, several months after uploading, you get a message that they received a notification from the company itself (in my case that was HBO) and they had to put the video down.

That's what happened with my Everwood video. I got a message that they received a "third-party notification by Warner Bros. Entertainment Inc. claiming that the material is infringing" and as a result deleted the video.

So I think people over there check the material uploaded on video plateforms.

The good thing is, I didn't received any official warning like with Youtube. ;-)

I've recently gotten automatic notices from youtube about videos I posted a few years ago. I think they used songs from a small record company, and it might be that youtube only added a search for their content recently.

I looked it up when I had my own troubles with this issue, and I think that according to youtube, btw, there's no difference between the two types of notices. Every copyright owner can decide what to do when the automatic filters catch a video they think violates their copyright. They can do nothing, add ads, restrict countries or remove it.

That's true. One of my fanvids on Youtube used to be available for the entire world and now it's blocked in Germany.

But there are 2 different notifications: the one that just "tags" your video (whatever the consequences for the video), and the one coming from "third-parties" that leads to a 6 month warning in your account...

You're right. I do wonder though.. It's hard for me to believe that somebody is actually sitting there and watching clips trying to find copyright violators. There's much better automatic tools.

But it's good to know vimeo don't ban you. I'm not sure I could deal with another service like that.

ETA: Actually, it might be that with a password, the video service isn't legally obligated to remove content.

Good idea. I'll try to re-upload the video and protect it with a password. We'll see.

I think the only ultimate solution would be to host my videos myself...

A small site won't attract much legal attention, but be careful - if anybody does care to sue, you'll be the one sued. Right now YouTube or Vimeo or whoever is the target.
